Are porta potties required on construction sites?
Yes, from the first day workers are on site. Cal/OSHA 8 CCR §1526 requires a minimum of one separate toilet facility for each 20 employees or fraction thereof of each sex, and the standard applies to every construction operation in California regardless of project size or duration.
Three details that catch contractors:
- "Or fraction thereof" means round up. 21 men need 2 toilets, not 1.
- "Of each sex" means a mixed crew of 6 needs 2 toilets, one for men and one for women, even if only one worker is a woman. Only crews under 5 may share a single lockable unit.
- Urinals count for up to half. A 40-man crew can use 1 toilet and 1 urinal instead of 2 toilets, but a standard porta potty with a urinal already satisfies this, so in practice the toilet count is what matters.

Two notes on the math. A crew of 4 could run a single lockable unit under the small-crew rule; the moment the fifth worker arrives, the per-sex count applies, which is why we quote the 3-unit pack for any crew that will grow past 4. What about hand washing stations?
One washing station per 20 employees, near the toilets, with soap and single-use towels or a warm-air blower. That is Cal/OSHA §1527, and the two things inspectors cite most are stations placed far from the toilets and hand sanitizer offered in place of water.

Do women need a separate toilet on a construction site?
Under §1526, yes: the 1-per-20 count is per sex, so any site with women on the crew needs at least one toilet for them. AB 521 (2023) went further and directed Cal/OSHA to require at least one single-user toilet per jobsite designated for employees who identify as female or nonbinary, with the Standards Board to consider adoption by the end of 2025. How often should a construction porta potty be serviced?
